Tutor Agreement

1. Independent Contractor Relationship

By creating a tutor account on Headstart Language Center ("Headstart" or "Platform"), you agree to provide tutoring services as an independent contractor. You are not an employee, agent, partner, or joint venturer of Headstart. You are responsible for your own taxes, insurance, and compliance with applicable laws in your jurisdiction.

2. Eligibility and Verification

To teach on Headstart you must: (a) complete the tutor onboarding process including profile, introduction video, and identity verification; (b) pass Headstart's manual verification review (typically 2–3 business days); (c) maintain an active account in good standing.

Headstart reserves the right to reject any tutor application or revoke tutor status at its discretion.

3. Fee Structure

Headstart charges a 20% platform fee on each completed lesson.

You receive 80% of the gross lesson fee paid by the student.

For the first trial lesson with a new student (up to 30 minutes at 50% of your regular rate), Headstart waives its commission as goodwill for helping you acquire new students. You receive 100% of the trial lesson fee.

This fee structure may be updated with 30 days' notice.

4. Payout Schedule

Earnings from completed lessons enter a 7-day settlement hold from the lesson completion date to allow for student disputes.

After the settlement hold, earnings move to your available balance.

Payouts are processed on the 15th and last calendar day of each month. Minimum payout threshold is ₱500 (or equivalent in your payout currency).

Payout methods: bank transfer, GCash, PayMaya, or international transfer via Wise at mid-market exchange rate. Specific methods available may depend on your country.

5. Quality Standards

You agree to: (a) show up on time for all scheduled lessons; (b) maintain a professional and respectful demeanor; (c) provide lessons that match your stated qualifications and teaching subjects; (d) respond to student messages within 24 hours; (e) keep your availability calendar up to date.

6. Cancellation Policy

If you need to cancel a confirmed lesson, you must do so as early as possible and the student will receive a full refund.

Cancellation rates above 10% of scheduled lessons in a rolling 30-day period may result in account review. Repeated cancellations or no-shows will result in account suspension.

7. Performance and Account Standing

Accounts with an average rating below 3.5 (out of 5) over 10 or more reviews will be placed under review. Accounts with persistent low ratings may be suspended.

Students are encouraged to leave honest reviews. Tutors must not solicit fake reviews or offer incentives for positive ratings.

8. Content Rights

You retain ownership of any original teaching materials you create and use in lessons. By using the Platform, you grant Headstart a non-exclusive, royalty-free license to display your profile, introduction video, and lesson statistics on the Platform for the purpose of student matching.

9. Termination

Either party may terminate this agreement at any time with 14 days' written notice to support@headstart.asia.

Headstart may terminate immediately for: fraudulent activity, abusive behavior toward students, persistent policy violations, or other conduct that harms the Platform community.

Upon termination, your available earnings will be paid out within 30 days, less any outstanding disputes or chargebacks.

10. Tax Compliance

You are solely responsible for declaring and paying any taxes on your tutoring income in your jurisdiction. Headstart does not withhold taxes on your behalf. For Philippines-based tutors, you are responsible for BIR registration and compliance as a self-employed professional.

11. Non-Exclusivity

This agreement is non-exclusive. You are free to teach on other platforms or independently. There is no non-compete obligation.
